Terms & Conditions
These terms govern the relationship between Sundara and guests booking any charter service. Please read them before confirming a booking.
These Terms and Conditions apply to all charter bookings made with Sundara, operating from 71/9 Railay East Road, Ao Nang, Krabi 81000, Thailand. By confirming a booking with us — whether by phone, email, or online enquiry — you agree to the terms set out below. If anything is unclear, please contact us before confirming.
Bookings & Confirmations
A booking is confirmed once Sundara issues a written confirmation (by email or message) and a deposit is received. Enquiries and provisional holds do not constitute a binding booking.
You must provide accurate information about your group size, any special requirements, and the names of all passengers on multi-day voyages. Sundara reserves the right to decline or cancel a booking if information provided is found to be materially inaccurate.
Bookings are accepted for groups up to the vessel's stated capacity. Exceeding this capacity is not permitted under any circumstances.
Pricing & Payment
All prices are quoted in Thai Baht (฿) and are for the full vessel unless otherwise stated. Prices include items listed in each charter description (meals, snorkelling equipment, park fees where applicable). Items not listed are not included.
A deposit of 30% of the total charter fee is required to secure a booking. The remaining balance is due no later than 48 hours before the charter departure, unless otherwise agreed in writing.
Payments may be made by bank transfer, cash, or other methods confirmed in writing by Sundara. Receipts will be issued for all payments received.
Prices are subject to change for future bookings. Any price confirmed in writing at the time of booking will be honoured for that booking.
Cancellations & Rescheduling
Cancellation policies are as follows:
- More than 14 days before departure: Full deposit refunded, less any bank transfer fees incurred.
- 7–14 days before departure: 50% of deposit refunded.
- Less than 7 days before departure: Deposit is non-refundable.
- Less than 48 hours before departure: Full charter fee is non-refundable.
Rescheduling requests made more than 72 hours before departure will be accommodated where availability allows, without penalty. Rescheduling within 72 hours of departure is treated as a cancellation under the policy above.
If Sundara must cancel a confirmed booking for reasons within our control (not including weather — see Section 4), a full refund will be offered, or an alternative date if preferred.
Weather & Safety
The captain holds absolute authority over all safety decisions. If conditions at sea are, in the captain's assessment, unsuitable for sailing, the charter may be modified, rescheduled, or cancelled.
In the event of a weather-related cancellation, Sundara will offer a rescheduled date at no extra charge. Where rescheduling is not possible, a full refund of any amounts paid will be issued.
Weather-related modifications to the route or itinerary (including alternative anchorages or shortened passages) do not entitle guests to a refund, as such decisions are made in the interest of safety and passenger comfort.
Sundara monitors official Thai Meteorological Department forecasts and local marine advisories. Guests are encouraged to check conditions independently and to raise any concerns before departure.
Guest Conduct
All guests are expected to treat crew members, fellow passengers, and the vessel itself with care and respect. Behaviour that endangers others, causes distress to crew, or damages the vessel or its equipment may result in the charter being ended early, at the guest's expense.
Alcohol is available on most charters. Sundara reserves the right to limit or decline alcohol service where a guest's condition poses a safety concern.
Smoking is permitted only in designated areas on deck, away from fuel and sails.
Any guest who boards in a condition that the captain deems unsafe — including but not limited to intoxication or evident medical instability — may be declined boarding. In such cases, the charter fee is non-refundable.
Health & Fitness to Sail
Guests with known medical conditions that may be affected by motion, sun exposure, or physical activity should consult a medical professional before booking and must disclose relevant conditions to Sundara at the time of booking.
Sundara does not carry a medical professional onboard. First aid equipment is available, but guests requiring ongoing medical supervision should assess whether a sailing charter is appropriate for their circumstances.
Children are welcome on all charters. Parents or guardians are responsible for children's safety at all times, including the use of life jackets, which are provided.
Guests with limited mobility should discuss their requirements in advance so we can advise on vessel accessibility and plan accordingly.
Liability
Sundara operates within the framework of Thai maritime law and holds appropriate vessel insurance. Our liability for loss, injury, or damage arising from a charter is limited to the extent permitted by applicable Thai law.
Sundara is not liable for loss of personal belongings, electronic equipment, or valuables brought aboard. Guests are encouraged to leave valuables ashore or ensure personal travel insurance covers these items.
Sundara is not responsible for events beyond our reasonable control, including severe weather, medical emergencies, or acts of third parties.
Guests participate in water activities (swimming, snorkelling) at their own risk. Life jackets are available and their use is encouraged. The crew will advise on conditions before any water entry.
Damage & Loss
Guests are responsible for any damage to the vessel, its equipment, or its furnishings caused by negligent or wilful conduct during the charter. The cost of repair or replacement will be assessed by Sundara and invoiced to the responsible party.
Normal wear and use are not the guest's responsibility. Sundara will make a fair assessment of any damage claim and discuss it with the guest before seeking reimbursement.
Any items lost overboard by guests — including personal equipment such as snorkelling gear — may be charged at replacement cost if the item belonged to Sundara.
Photography & Privacy
Guests are welcome to photograph and film during their charter for personal use. Sundara crew members may also take photographs during the voyage for use on our website and marketing materials. Please let us know before departure if you would prefer not to be photographed.
Photographs that identify crew members or other guests should not be published without their consent. Sundara will not share identifiable guest photographs with third parties without permission.
Itinerary Changes
The itineraries described for each charter are representative of a typical voyage and are not binding. Actual routes are determined by the captain based on weather, tidal conditions, sea state, and passenger preference on the day.
We aim to visit all described locations where conditions allow. Where a stop is not possible due to circumstances beyond our control, we will offer an alternative of similar character where available.
Itinerary adjustments made for safety or operational reasons do not constitute a material change to the service and do not entitle guests to a refund.
Governing Law
These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any dispute arising from a charter booking that cannot be resolved amicably will be subject to the jurisdiction of the competent courts in Krabi Province, Thailand.
These terms do not affect any statutory rights you may have as a consumer under Thai consumer protection law.
